If parties have cohabited together and either separated or one has passed away, the remaining cohabitant may be entitled to make a financial claim. There are very strict time limits for these applications – six months if a cohabitant has passed away and one year if the cohabiting couple have separated.
Cohabiting couples do not have the same rights as those that are married or in civil partnerships. The tests to be applied are ones of financial advantage and disadvantage. It is important to understand how these tests apply to each individual set of circumstances.
The starting point is always to try and negotiate an agreed settlement, but if that fails then we can assist you in raising a court action, to ensure that your rights are protected.
